Linden Couple in Serious Condition After Crosswalk Collision

A couple from Linden, New Jersey were seriously injured on October 25, 2011 when a pickup truck struck them as they crossed North Wood Avenue in Linden. Su R. Choo, 88, was walking with his wife Soonok Chuang, 84, east across North Wood Avenue in the crosswalk when they were hit by a silver 2011 Toyota Tundra operated by Tomasz Leszczyk, of Edison, New Jersey. Leszczyk was making a left turn from Elizabeth Avenue on to North Wood Avenue when the collision occurred around 6:20 p.m. Both Choo and Chuang were transported to University Hospital Newark by ambulance. As of October 26th, Choo was still listed in critical condition and Chuang was listed in serious condition. The extent of their injuries is not yet known.

Linden police have advised that this tragic accident is still under investigation and no charges have been filed yet. Regardless, of whether criminal charges are filed against Mr. Leszczyk, the victims certainly have a viable civil action for his negligence that resulted in their injuries. Under New Jersey law, a person seeking to make a left-hand turn has the duty to seek an opportune moment and to exercise a degree of care in proportion to the increased danger involved in the turn. Additionally, drivers have an obligation to yield to pedestrians lawfully crossing in a crosswalk. Clearly, Mr. Leszczyk was negligent in those duties, which that unfortunately resulted in Choo and Chaung’s severe injuries..
